Terms of Service

1. The Service

Five Second Sports is an 18+ sports analytics and fantasy football platform. The Service may include curated news and article summaries, fantasy team tools, AI-powered advice and analyst personas, alerts, bookmarks, and related features. Feature availability may vary by plan and may change as we launch or update products.

The Service is not a real-money sportsbook, casino, or gambling product. We do not accept wagers, facilitate betting, or pay out gambling winnings.

2. Eligibility

You must be at least 18 years old to create an account or use the Service. By using the Service, you represent that you are at least 18 and capable of entering into a binding agreement. We may require you to confirm your age and acceptance of these Terms and our Privacy Policy before accessing certain features.

3. Account Registration

To access certain features, you must create an account and provide accurate, complete, and current information. You may register with email and password or through supported single sign-on providers (such as Google or Yahoo). You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us promptly if you suspect unauthorized access.

4. Plans, Usage Limits, and Billing

We may offer free and paid plans with different feature sets and usage allowances. Free access and “unlimited” or high-volume features may be subject to fair-use rate limits, throttling, or usage balances to protect service quality. We may change plan features, limits, and pricing with notice as described in these Terms.

If you purchase a paid plan or credits when available, fees are due as described at checkout. Unless required by law, fees are non-refundable. Failure to pay may result in suspension or downgrade of paid features.

5. AI Advice and Content Disclaimer

Parts of the Service use artificial intelligence and automated systems to generate summaries, recommendations, and other content (including start/sit, waiver, trade, and lineup guidance). AI outputs are for informational and entertainment purposes only. They may be incomplete, outdated, or incorrect, and they are not professional, legal, financial, or gambling advice.

You are solely responsible for any decisions you make based on the Service, including fantasy sports lineup and roster decisions. We do not guarantee outcomes, rankings, or performance in any league or contest.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Violate any applicable laws or regulations;
• Submit content that is defamatory, obscene, hateful, violent, sexually explicit, or otherwise prohibited by our content policies;
• Attempt to use the Service for real-money wagering, or to solicit or facilitate illegal gambling;
• Attempt to gain unauthorized access to the Service, accounts, systems, or networks;
• Interfere with, disrupt, scrape, or overload the Service, or circumvent rate limits, usage balances, security, or access controls;
• Misuse AI features (including automated bulk querying, prompt injection intended to bypass safeguards, or reverse engineering our models or systems); or
• Impersonate others or misrepresent your identity or affiliation.

7. Content Ownership

The Service—including software, design, branding, curated summaries, and other materials we provide—is owned by or licensed to us and protected by applicable intellectual property laws. You may not copy, distribute, modify, or create derivative works from any part of the Service except as expressly allowed by these Terms or with our prior written consent.

Third-party articles, stats, trademarks, and other materials displayed or linked through the Service remain the property of their respective owners. Links and references do not imply endorsement.

8. User Content and Fantasy Data

You may submit content through the Service, including chat messages, feedback, fantasy team and roster information, bookmarks, and other materials (“User Content”). You retain ownership of your User Content. By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, host, process, display, and distribute it as needed to operate, improve, secure, and provide the Service (including personalizing advice and maintaining conversation history).

You represent that you have the rights needed to submit User Content and that it does not violate these Terms or any third-party rights. We may remove or refuse User Content that violates these Terms.

9. Personalization

Five Second Sports may use your account information, reading activity, fantasy teams, preferences, and interactions with AI features to personalize recommendations, advice context, and other parts of the Service. Details on how we collect and use data are in our Privacy Policy.

10. Email Communications

By creating an account, you agree that we may send you service-related emails (such as account verification, security notices, and product updates). We may also send marketing emails. You can opt out of marketing emails at any time using the unsubscribe link in those messages. Essential account or security messages may still be sent.

11. Termination

We may suspend or terminate your account at our discretion if we believe you have violated these Terms or engaged in fraudulent, abusive, or unlawful activity. You may stop using the Service at any time and may request account-related assistance by contacting us. Provisions that by their nature should survive (including ownership, disclaimers, limitation of liability, and indemnification) will survive termination.

12. Disclaimer of Warranties

The Service is provided “as is” and “as available,” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that any content— including AI-generated advice, news summaries, stats, or alerts—will be accurate, complete, current, or reliable.

13. Limitation of Liability

To the maximum extent permitted by law, Five Second Sports and its affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of or inability to use the Service, including losses related to fantasy sports outcomes or reliance on AI or other content. Our total liability for any claim related to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve months before the claim or (b) one hundred U.S. dollars (US $100) if you have not paid us.

14. Indemnification

You agree to defend, indemnify, and hold harmless Five Second Sports, its affiliates, and their respective officers, employees, and agents from any claims, damages, or expenses arising out of your use of the Service, your User Content, or your violation of these Terms.

15. Changes to These Terms

We may update these Terms periodically. The updated version will be posted on this page with a new effective date. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. If you do not agree, you must stop using the Service.

16. Governing Law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Delaware for any disputes arising under these Terms.
